Laughing gas, alcohol and other substances can now be confiscated in Ashby following the introduction of new anti-social behaviour rules.

The powers have been introduced North West Leicestershire District Council (NWLDC), which last night (Tuesday) approved a public spaces protection order (PSPO), covering the town centre, Hood Park and Bath Grounds.

The PSPO gives the police, and other authorised officers such as PCSOs, the power to confiscate alcohol or psychoactive substances including nitrous oxide, khat and spice, if there are concerns around anti-social behaviour.

Drinking in public and on licensed premises is still allowed, but if officers believe alcohol is fuelling anti-social behaviour they can use the new powers to remove it.

Psychoactive substances are banned from the area, anyone found with them will be asked to hand them over to the police or an authorised officer.

Refusing to hand over alcohol or psychoactive substances when requested could result in a £100 fine. Anyone failing to pay the fixed penalty notice could face prosecution.

The order was granted by NWLDC's Cabinet following a three-week public consultation and support from Ashby de la Zouch Town Council.

The PSPO will be in place for three years before being reviewed.

Cllr Andrew Woodman, Chair of the North West Leicestershire Community Safety Partnership, said: "Ashby is a vibrant town with low levels of crime compared to other areas, but we know that anti-social behaviour is a concern for many residents.

"During our consultation we heard from a lot of people who are concerned about the impact of alcohol and substance misuse on the town, especially at night.

"With the town council, residents and businesses calling for action, the PSPO will give the police and PCSOs the power to clamp down on anti-social behaviour."

John Coxon, Leader of Ashby de la Zouch Town Council, added: "We are committed to the ongoing safety and vibrancy of the night time economy in Ashby de la Zouch.

"The introduction of the PSPO helps us promote our commitment to safety and high standards and complements our Purple Flag award."
