Ashby Couple Ordered To Destroy Banner Critcising Home Builder - After 'Heartbreaking' Problems With New House

An Ashby couple say they been ordered to take down and destroy a large banner which criticised the company that built their house.
Bellway Homes also told them to remove a photo of it from social media after being threatening them with legal action.
Jake and Chloe Wright say they have been 'heartbroken' ever since moving into the property.
So they draped the banner which read: 'Buying a Bellway Home Was Our Worst Decision - Please Ask Us Why'.
They bought the house 18 months ago but say they have had constant worries about the property - including getting calls from family while they were on honeymoon to report on more problems.
In the end, they got a giant banner printed in Measham and hung it from the first floor down to the front garden.
It was then posted on Facebook and that is when Bellway stepped in to send them a letter demanding it be taken down.
Not only that, they said it had to be destroyed so that it could not be put up again.
Bellway also told them to take down their Facebook post showing the banner otherwise they would have taken legal action against them.
The company told Ashby Nub News on Friday afternoon that no further action would now be taken after the banner was removed,
The Wrights were informed on Wednesday afternoon that that they had to get rid of the banner by mid-day on Thursday.
Jake told Ashby Nub News: "We did that at 11.59!
"We don't have it any more, they told us they had to destroy it, that was one of the conditions.
"Bellway said it was defamatory.
"But I think we've made our point.
"We designed the banner and got the measurements right before having it printed."
It was the last resort for the couple who have had flooding problems at the property among other issues.
But Chloe added: "I still think we are entitled to our freedom of speech.
"Anyone can post reviews online if you're not happy.
"We had less than four working hours to get a solicitor on our side, which wasn't possible.
"It's been heartbreaking, we've spent a lot of our money on the house but they still have the power to send us a letter."
Jake said: "It says in the small print we can't fix a sign up.
"But we weren't saying all Bellway Homes were the same, just that we'd had problems with ours.
"We moved here from Ibstock and were really looking forward to living in Ashby.
"But now we wouldn't have another new-build house again. We'll go for an older property.
"Bellway said people were coming to them and saying they wouldn't buy from them now so it was loss of income.
"But we've had positive feedback from people on the estate.
"Now we'll write to MPs to get something done in Parliament to give people a like us a bit more protection, maybe 12 months after moving in.
They do not intend to leave the matter there however and plan to contact their MP to take it further.
Jake said: "The garage level is lower than the garden, we moved in and it was flooding.
"They came out, then it flooded again. The bricks were wet. The water was coming in through the ground. That meant they came in to redig the majority of the garden to put it right.
"It was supposed to take a week, but it was three to four weeks.
"They were still tidying up the house the day before our wedding. We couldn't do the wedding photos here as the house was a mess."
Chloe added: "They did pay for me to get ready at the venue and provided bottles of champagne for the wedding."
But Jake said: "We were on our honeymoon and got a phone call to say the garage was flooded again.
"It meant they'd done something incorrectly twice.
"Then they said they wouldn't do anything to the garden until they'd got the garage right.
"We then contacted the NHBC who ruled in our favour.
"We kicked up a fuss after Bellway had said they'd flatten the garden and install a patio.
"But their solution was the equivalent of putting a bucket under a leak and keep emptying it. An internal drain on the inside.
"They coming here again on Monday. But it's been one thing after another.
"We woke up one morning and the ensuite in the master bedroom was flooded.
"The garden still isn't done and the garage still leaks, so we're in a worse position than we were in the first place.
"People have had similar problems after our house was built."
Ashby Nub News has approached Bellway Homes for a response and to comment on the latest events.
And they issued the following statement: "While we are unable to comment specifically due to customer confidentiality, we have been working hard to resolve the issues the customer has faced, and we continue to undertake remedial work over and above our warranty commitments.
"Our legal representatives have written to the customer in order to request the removal of the signage, which is in breach of the restrictive covenants entered into at the point of sale.
"As the sign has been removed, no further action will be taken."
